Children should be able to play with toys without their parents or caregivers having to worry about lead poisoning, design flaws or other problems associated with defective products. Manufacturers and other companies involved in the distribution of toys and other children related products often cut corners, which can be deadly for children. In 2007, 18 children were killed in toy-related accidents in the United States. That same year, there were an estimated 232,900 toy-related injuries treated in hospitals.
According to the U.S. Consumer Product Safety Commission (CPSC), there has been a significant increasing trend in toy-related injuries from 2003 to 2007. Children are often the victims of defective toys and approximately 170,100 of the reported injuries in 2007 involved children under the age of 15.
The reported injuries ranged from minor cuts and bruises to more serious abrasions. Tricycles were the leading cause of death in 2007, accounting for five of the 18 deaths. Airway obstruction involving rubber balls was a close second, which claimed the lives of four children.
Lead exposure has become a major concern for parents, as many products are now manufactured in China. Every year, numerous products are pulled off the shelves in the United States because they are tainted with lead. Countless children’s products and toys have been found to contain lead-based paint, making children especially at risk of lead exposure.
Manufacturers can be held liable when injuries occur from a defective toy or other product, such as a crib, playpen, bicycle or article of clothing. These types of cases are known as product liability and can be difficult to prove. The manufacturer will try argue that they were not responsible for the injuries, so it is important to work with an experienced Kentucky defective product lawyer who has the knowledge, resource and experience to build a strong case on your behalf.
