Cochlear Nucleus Implants Continue to Fail and Cause Injuries

Reports continue to come in to the FDA regarding problems with the Cochlear Nucleus Implant, which was initially recalled in 2011. At that time, Cochlear Americas told the FDA that there had been a limited manufacturing problem involving the feedthrough for the device and moisture causing premature failures. However, 5 years later, the FDA continues to receive high numbers of failures for the device.

Our attorneys have previously represented families affected by a similar defect with Advanced Bionics feedthrough in their cochlear implants. All cases are different and we do not yet know all the facts regarding the Cochlear Nucleus Implants. However, in the Advanced Bionics litigation, we were able to show a jury in the only case to go to trial that the company was aware there was a problem and had claimed it was fixed, even though it wasn't. The jury awared $7.24 million to our client and her family for the shocks and trauma she experienced along with the medical care that she required. Our other cases settled shortly thereafter.
